As another year draws to a close, we approach the festive season, which is a time for family and celebration. For some separated parents, it can also bring stress - especially when holiday parenting arrangements are unclear. If you anticipate any disagreement about where the children will spend Christmas or the summer holidays, early action is crucial.
The Federal Circuit and Family Court of Australia (FCFCOA) has strict filing deadlines for parenting applications relating to the Christmas and summer holiday period. For 2025, the deadline is 4:00 pm on Friday, 14 November. Applications filed after this date may not be heard before Christmas unless they meet urgent criteria.
We are still some weeks away from Christmas, however it is important to discuss and plan for what arrangements may look like for Christmas Day, Christmas Eve, and summer holiday schedules. If you are unable to reach agreement with your former spouse regarding what time the Children are to live with each of their parents, then you should first consider mediation.
Good Family Dispute Resolution Practitioners are busy, with some requiring bookings well in advanced. Courts expect genuine attempts to resolve disputes outside litigation, and before you are able to file an application with the Court- unless urgent.
If you miss the filing date, your matter will likely be listed after Christmas unless urgent. This can lead to uncertainty and unnecessary stress during the holidays.
If you need formal parenting arrangements for Christmas, don’t wait. Contact us at Gannon Family Law today to discuss your options, arrange mediation, and ensure your application is filed before the deadline. Early action means less conflict and more focus on what matters most—the children.
